Plain-English summary. You share HomeAtlas, we pay you a commission when people you refer subscribe to a paid plan. These terms spell out the rules, payment mechanics, and a few things you can't do. By creating a referral link, you agree to all of them.

1. Acceptance and parties

These Affiliate Program Terms (the "Terms") form a binding agreement between you ("you", "Affiliate") and HomeAtlas ("HomeAtlas", "we", "us"). They govern your participation in the HomeAtlas Affiliate Program (the "Program").

By creating a referral link, generating a referral code, or otherwise enrolling in the Program, you confirm that you have read, understood, and agree to be bound by these Terms and by the HomeAtlas general Terms of Service and Privacy Policy, each as updated from time to time. If you do not agree, do not participate in the Program.

3. Eligibility

To participate in the Program you must:

  1. Be at least 18 years old (or the age of legal majority in your jurisdiction, if higher);
  2. Have the legal capacity to enter into a binding contract;
  3. Hold an active HomeAtlas account in good standing;
  4. Not be a resident of, or located in, a country subject to comprehensive economic sanctions administered by the United States, United Kingdom, European Union, or Australia; and
  5. Not be on any government sanctions or restricted-persons list.

HomeAtlas employees, contractors, and members of their immediate household may participate as Affiliates but are not eligible for elevated commission tiers without prior written approval.

4. Enrollment

Enrollment is open and self-serve. Any HomeAtlas account holder may generate Referral Links from the in-product referrals dashboard. No application or approval is required for the standard Program tier.

HomeAtlas may, in its sole discretion, invite high-performing or strategic Affiliates to an elevated commission tier with different rates and benefits. Elevated tiers may impose additional terms communicated at the time of invitation.

5. Referral links and tracking

5.1 Attribution window

When a visitor clicks your Referral Link, we record the click and set a first-party tracking cookie identifying you as the referrer. If that visitor creates a HomeAtlas account within the attribution window configured for the Program (currently 90 days, subject to change with notice), they are attributed to you. The window resets on each new click on a Referral Link (last-click attribution).

5.2 Cookie behaviour

Attribution relies on the visitor's browser accepting our first-party cookie. We do not guarantee attribution where a visitor clears cookies, uses private browsing, switches devices, or otherwise prevents tracking.

5.3 Single attribution

A given user can only be attributed to one Affiliate at a time. If the same person clicks multiple Referral Links, the most recent click within the attribution window controls.

5.4 Code limits

You may hold up to a limited number of active Referral Codes at any time (currently 5). Codes expire after a default period (currently 90 days) unless extended.

6. Commission and rewards

Commission rates depend on the eligible product or plan a Referred User subscribes to and on your current tier. Current rates and tier thresholds are shown on your referrals dashboard and may include:

HomeAtlas may add, remove, or change commission rates, products, tiers, and bonuses prospectively. Changes apply to Qualifying Conversions occurring after the change becomes effective and do not retroactively reduce already-earned Commission.

7. Credits vs. cash payouts

Commission accrues as HomeAtlas account credits by default. Credits are usable inside HomeAtlas, are non-transferable, and have no cash-redemption value except as described in this Section 7.

You may elect to switch to cash payouts once your lifetime Program earnings meet or exceed the cash-payout threshold (currently US$100 equivalent, subject to change with notice). To enable cash payouts you must complete the onboarding flow with our payment provider, Stripe, and provide all information Stripe requires, including identity verification, tax information, and a valid bank account in a supported country.

Switching to cash payouts is forward-looking only. Credits already issued before the switch are not converted to cash.

8. Payment terms

8.1 Schedule

Cash Commissions are paid on a weekly batch schedule. Payouts settle to your bank on the schedule Stripe applies for your jurisdiction, typically two business days after the batch runs but sometimes longer.

8.2 Currency

Commissions are calculated in the currency in which the Referred User pays, then converted to your payout currency at the exchange rate Stripe applies at the time of payout. Currency-conversion costs incurred by Stripe may be deducted.

8.3 Holds and adjustments

HomeAtlas may withhold a Commission, place a payout on hold, or adjust your Commission balance to investigate or resolve suspected fraud, refunds, chargebacks, errors, disputes, or violations of these Terms.

8.4 Inactive accounts

If your HomeAtlas account becomes inactive for 24 consecutive months and your accrued Commission balance is below US$10 equivalent, we may close the balance to zero. Accounts with balances above that threshold will be contacted before any forfeiture.

9. Taxes

You are solely responsible for any taxes, levies, duties, or superannuation contributions arising from your participation in the Program. HomeAtlas does not withhold income tax from your Commissions except where required by law.

Stripe collects tax documentation (W-9 for US persons, W-8BEN for non-US persons, or equivalents) during onboarding for cash payouts. Where required by law (for example, US IRS Form 1099-K thresholds), Stripe will issue tax forms directly to you. You must provide accurate and up-to-date tax information; we may suspend payouts where required information is missing or incorrect.

10. Prohibited conduct

You must not, and must not encourage anyone else to:

  1. Bid on HomeAtlas brand terms (including "HomeAtlas" and any misspellings) in paid search advertising on Google, Bing, or any other search engine or advertising platform;
  2. Use the HomeAtlas name, logo, or trademarks in a domain name, subdomain, social-media handle, or paid advertising creative without our prior written consent;
  3. Send unsolicited bulk email (spam), SMS, or direct-message blasts promoting Referral Links;
  4. Post Referral Links in coupon, deal, or cashback websites and browser extensions without prior written approval;
  5. Misrepresent HomeAtlas, its features, pricing, privacy practices, or affiliation with any third party;
  6. Promote HomeAtlas in connection with any unlawful, deceptive, sexually explicit, harassing, hateful, violent, or discriminatory content;
  7. Use any automated method (bots, scripts, click farms, incentivised traffic) to generate clicks, impressions, sign-ups, or conversions;
  8. Attempt to circumvent the attribution system, manipulate cookies, or otherwise interfere with how Commissions are calculated;
  9. Acquire HomeAtlas accounts in bulk, resell them, or operate as a reseller without a separate written agreement;
  10. Engage in any activity that would reasonably bring HomeAtlas into disrepute.

11. Self-referrals and fraud

Self-referrals are prohibited. You may not refer yourself, members of your household, accounts you control, or accounts created at your direction. Commissions on self-referrals are void and may be clawed back even after payout.

We use a combination of automated heuristics and manual review to detect fraudulent activity. Examples of conduct that will be treated as fraud include but are not limited to: multiple accounts created from the same device or IP shortly after a referral click; accounts that cancel immediately after the protection window closes in a coordinated pattern; payment-method recycling across Referred Users; and stolen-card sign-ups.

12. Refunds, chargebacks, and clawbacks

Commissions are calculated on Qualifying Conversions. If a Referred User is refunded, charges back, or has their payment reversed during the protection window (typically the first 30–90 days after payment, depending on plan), the corresponding Commission is reversed (a "Clawback").

Clawbacks are settled in one of two ways:

We do not invoice Affiliates for negative balances; we work them down against future earnings. If your account is closed while carrying a negative balance arising from fraud, we may pursue recovery by reasonable means.

13. Disclosure requirements

When promoting HomeAtlas you must clearly and conspicuously disclose your affiliate relationship in any place where a reasonable person could miss it. This includes (without limitation) social-media posts, video descriptions, blog articles, podcast episodes, newsletters, and live streams.

You are responsible for complying with all applicable disclosure laws and platform rules, including but not limited to the United States Federal Trade Commission Endorsement Guides, the Australian Consumer Law (in particular the prohibitions on misleading or deceptive conduct under sections 18 and 29 of the Australian Consumer Law), the UK Advertising Standards Authority CAP Code, and the EU Unfair Commercial Practices Directive.

14. Brand usage and intellectual property

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the HomeAtlas name and approved logos solely to promote the Program in accordance with these Terms. All other rights are reserved.

You must not modify the HomeAtlas logo, combine it with other marks, or present it in a way that implies endorsement of, or association with, your other products or services beyond your Program participation.

You retain all rights to content you create promoting HomeAtlas. By sharing it publicly with your Referral Link you grant us a non-exclusive, royalty-free licence to repost or reference that public content with attribution.

15. Confidentiality and data

You may receive non-public information about HomeAtlas and the Program, including planned features, commission economics, and tier criteria. Treat all such information as confidential and do not disclose it to third parties without our prior written consent.

HomeAtlas processes personal information about you and your Referred Users in accordance with its Privacy Policy. You must not collect, store, or process personal information about Referred Users obtained through your participation in the Program except as strictly necessary to operate your own promotional activities and in compliance with applicable privacy law (including the EU/UK GDPR and the Australian Privacy Act 1988 where they apply to you).

16. Independent-contractor relationship

You are an independent contractor and not an employee, agent, partner, or joint-venturer of HomeAtlas. Nothing in these Terms creates an employment, agency, partnership, or fiduciary relationship between you and HomeAtlas. You may not enter into contracts, make representations, or incur obligations on behalf of HomeAtlas.

17. Suspension and termination

17.1 By you

You may stop participating in the Program at any time by revoking your Referral Codes and ceasing to use new ones. Termination by you does not forfeit accrued, undisputed Commission earned before termination.

17.2 By HomeAtlas

We may suspend or terminate your participation in the Program at any time, with or without notice, if we reasonably believe you have breached these Terms, our general Terms of Service, or applicable law, or if continued participation would be commercially or reputationally damaging.

17.3 Effect of termination

On termination, your Referral Codes will be revoked, your dashboard access to historical data may be reduced or removed, and any unpaid Commission will be paid out in the next regular payout cycle subject to Clawbacks and to any holds under Section 8.3. Termination for fraud forfeits all unpaid Commission.

18. Disclaimers

The Program is provided "as is" and "as available". To the maximum extent permitted by law, HomeAtlas disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or trade usage.

We do not warrant that the Program will be uninterrupted or error-free, that tracking will be 100% accurate in all circumstances, that any particular level of Commission can be earned, or that the Program will continue indefinitely.

Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law or any other consumer-protection law to the extent that such exclusion would be void or unenforceable.

19. Limitation of liability

To the maximum extent permitted by law, in no event will HomeAtlas, its affiliates, officers, directors, employees, or agents be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost goodwill, or loss of data, arising out of or related to the Program, even if advised of the possibility of such damages.

Our aggregate liability to you arising out of or related to the Program, on any theory of liability, will not exceed the greater of (a) the total Commissions paid to you in the twelve (12) months preceding the event giving rise to the claim, or (b) US$100.

20. Indemnification

You will indemnify, defend, and hold harmless HomeAtlas and its affiliates from and against any third-party claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your promotional activities, including the content you publish to promote HomeAtlas; (c) your violation of any applicable law, including disclosure, advertising, privacy, tax, and consumer-protection laws; or (d) your gross negligence or wilful misconduct.

21. Modifications

We may modify these Terms, commission rates, tier criteria, the attribution window, the cash-payout threshold, or any other aspect of the Program at any time. Material changes will be communicated by email to the address associated with your HomeAtlas account, by an in-product notice, or by updating the "Effective" date at the top of this page, at least seven (7) days before the changes take effect (or sooner if required by law or to address a security or fraud risk).

Your continued participation in the Program after the effective date of a change constitutes acceptance of the change.

22. Governing law and disputes

These Terms are governed by the laws of the State of Victoria, Australia, without regard to its conflict-of-law principles. The parties submit to the exclusive jurisdiction of the courts of Victoria and the courts of appeal from them, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

Before filing a formal claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. Most disputes can be settled this way within 30 days.
